LEXINGTON — The Dawson County attorney won’t prosecute the owner of 173 dogs rescued from filthy conditions near Lexington.

Elizabeth Waterman said Friday that officials’ primary object was to get the dogs away from the facility, so an agreement was negotiated with their owner.

Otherwise, she said, there would have been the enormous expense of caring for the animals while the case was pending.

As part of the agreement, the dogs’ owner will leave the commercial dog breeding business.

Two of the dogs were euthanized after their arrival in Omaha at the Nebraska Humane Society late Wednesday night.

The dogs had been kept in small buildings with scant water, surrounded by feces, urine stains and trash.

Many of the dogs were dehydrated, a Humane Society spokeswoman said, and many had skin issues and parasites. Several had bad teeth because their diet of soft food didn’t provide tooth stimulation for good dental health.

They are mostly small breeds.
