State agency accuses Suzuki Auto Plex of violations

Suzuki Auto Plex, 6401 N. 28th St., is facing a license suspension or revocation for repeated violations of law, including failure to provide vehicle titles to customers in a timely way, according to a notice of hearing  issued by the Nebraska Motor Vehicle Industry Licensing Board.  

Its owner, Chad Gutschow, and his attorney met with the agency’s executive director, William Jackson, Wednesday morning to discuss the case and whether the dealership would resist the charges, but came to no resolution, Jackson said.   "They're exploring their options," Jackson said.  

Auto Plex was scheduled to be given a hearing next Thursday to show cause why its license shouldn’t be suspended or revoked.  All its sales staff’s licenses  were at risk, as well, according to a notice of hearing. 

The notice says Auto Plex has been the source of “numerous consumer complaints” investigated and reviewed by the agency’s staff.

That caused Jackson to advise the dealership in February that it would be monitored.  

The dealership failed to modify business practices that violated the law, the notice says.

The licensing board gave several examples of the dealership’s failure to supply titles in a timely way. 

In a separate example of a “deceptive trade practice,” the board said Andrew Sutter of Lincoln was charged twice for a warranty service contract and charged for life and disability insurance he did not request.   The defendant was uncooperative when Sutter complained, the notice said. It took more than a year for Sutter to get his $3,393 back, the notice said.

Other examples showed the dealership failed to pay off loans on traded-in vehicles until confronted. 

“There are not less than ten separate violations of law set forth above, all committed by the Defendant,” the notice said.  Each could be grounds for suspension, revocation or a fine, the board’s notice said.

Gutschow could not be reached for comment Wednesday morning.
