Attorneys want Omaha auditor suit in federal court

OMAHA — Attorneys for Omaha’s former public safety auditor who says she was wrongfully fired have asked to have her lawsuit heard in federal court, rather than state court.

Tristan Bonn sued the city of Omaha in Douglas County District Court last month. Among other things, she is seeking back pay and reappointment to the job she held for five years.

Mayor Mike Fahey fired her in October 2006, saying she was insubordinate in releasing a report, without his approval, that criticized police traffic stops.

In documents filed in federal court this week, attorneys say the complaint raises federal issues. Among them, they allege her right to free speech was violated.

City attorney Michelle Peters has said she believes Fahey acted within the law.
