Meisinger gets year in prison for beating
By the Plattsmouth Journal
PLATTSMOUTH — Travis Meisinger was sentenced Tuesday to one year in prison for assaulting Tony Premo Sr. in September 2007.
Meisinger originally was charged with first-degree assault and assault with a deadly weapon, but a jury convicted him of third-degree assault by a jury trial in September of this year.
At a sentencing hearing Tuesday, Cass County District Judge Randall Rehmeier said Meisinger was not an appropriate candidate for probation and that he would impose the maximum sentence he could on third degree assault.
“Life presents to all of us a series of choices,” Rehmeier said. “Some make good choices, some make bad choices. You chose to go to Plattsmouth. You chose to bring some implements. There was a series of events that you could have backed up.”
Meisinger will also pay $9,000 in restitution. Rehmeier was restricted by state law as to the amount of restitution that could be paid and over what period.
Cass County Attorney Nathan Cox said the sentence was the best that could be done.
“I think the judge did everything he could do, given the jury verdict,” Cox said.
Premo, who attended the hearing, said he has not lost faith in the judicial system.
“I’m not mad at the justice system, I’m not mad at the court, I’m mad at the jury,” Premo said. “I’d have rather seen him charged with what they first charged him with and not gotten a penny. I’m glad that the judge gave him the max. I’m happy for that. It was the best we could get for what he did to me and my family.”
Anthony Houchin and Joshua Hauschild were both charged with felony assault last year. They have both accepted plea agreements. Houchin faces sentencing Nov. 3, while Hauschild will be sentenced Nov. 24. Plattsmouth resident Justin Johnson still faces trial on third-degree assault. He is scheduled to be tried Nov. 12.
Authorities alleged the three men beat Premo as he walked out the door of his home to investigate a disturbance on Sept. 9, 2007. The attack was related to a fight between groups of young people from Weeping Water and Plattsmouth.
