Suzuki Auto Plex surrenders license

Suzuki Auto Plex,  6401 N. 28th St., has surrendered its license to operate as a new-vehicle dealer in Nebraska, and the licenses of its staff, but the owner can continue to operate his used-vehicle dealership, according to the state agency that regulates those dealers.

Chadron Gutschow told William Jackson, executive director of the Motor Vehicle Industry Licensing Board, that he has sold the new-vehicle dealership to his father, Terry Gutschow, who will have to relicense it separately, Jackson said.

The board canceled a hearing it was to have conducted Thursday on civil license violations the board accused the new-vehicle dealership, formally known as Auto Plex of Lincoln, LLC,  of committing .

Jackson advised the dealership in February that it would be monitored because of numerous consumer complaints.

 The dealership failed to modify business practices that violated the law, according to a notice of hearing issued by the board.

Those violations included several failures to supply titles to new owners of vehicles and of failing to pay off loans on trade-in vehicles in a timely way. 

 In a separate example of a “deceptive trade practice,” the board said a Lincoln customer, Andrew Sutter, was charged twice for a warranty service contract and charged for life and disability insurance he did not request. It took more than a year for Sutter to get his $3,393 back, the notice said.

“There are not less than 10  separate violations of law...all committed by the Defendant,” the notice said. Each was grounds for suspension, revocation or a fine, the board’s notice said.

Gutschow and his attorney, Bob Creager, concluded the best course of action would be to surrender the license, Jackson said, and they did so Tuesday.

In the dealer’s formal answer to the board’s accusations, received by the board on Monday, the dealership generally admitted the allegations.

It also said the “financial institution that provided the inventory financing ... has ceased regular business operations and will no longer advance funds to any borrower, including the Defendant.”

That lender was not identified in the document, but Jackson said he understood it was a California institution.   The financing issue caused the dealer to be unable to clear liens and otherwise get titles to vehicles sold to its customers within the time period allowed by law, the document explained. 

Auto Plex tried to get a substitute lender but was unable to do so, Creager wrote in the document. 

So Auto Plex of Lincoln LLC  signed a contract to sell and contemplates the new dealer will assume regular business operations under a new license, the document said.

That buyer was not identified in the document but Jackson said the younger Gutschow told him it was his father, Terry.

Neither the Gutschows nor Creager could be reached for comment.  

The economy appears to be at least a contributing factor of this licensing trouble and the surrender of a used-car license by an Omaha dealer this week, Jackson said.

“Hopefully we’re not on a slippery slope where we’re going into several of these this year,” Jackson said.  “Let’s hope the economy stays strong enough that dealers can stay in business.”

" I have interacted with several dealerships in the past couple of years for personal, friends and extended family purchases. This Suzuki was far and away the worst. Some of the practices of the sales persons and the inappropriateness of everything from conversation to actual business interactions were downright scary and unbelievably bad. Despite what Jackson indicates, this is not an "economy" issue as much as it is just a poorly run business. The Suzuki itself was NOT a bad car so this is a shame that one has to go to Omaha or elsewhere to do business. I agree that transfer of the business to dad won't help. "

You pretty much can't get any other sort of state license, heck, you can't even cut hair. When it got close to the 30 day time frame that I had to by law license my car I started to fuss with Suzuki Autoplex to get my title. WRONG!! My car ended up parked in my garage for about a month because I could not license it. I ended up involving the Better Business Bureau (they were useless) and the Nebraska Dealers Board (they were great) in order to get my title. What sucked was I had to make payments on a car that I couldnt even drive! Yes, Suzuki Autoplex loaned me a car to drive during that time...but why did it take 2 months to get my vehicles title??? I got more dang excuses from this dealer as to "why" they didnt have my title. I wish now that I would have just walked away from the entire deal and went elsewhere. Which is what the NE Dealers Assn. recommended. I will never purchase another vehicle from this dealer no matter "who" owns it! Hmmm a family member taking over the dealership? Now, I am sure that will help it's credibility. NOT! Not only did I get the shaft when it came to getting my title. But, I also got ZERO $$$ for my trade in. When I questioned it..I got lied to. I am done with them! NEVER will I purchase from them. NEVER! "

" I made the mistake of buying a car there. They actually provided a "will do" form, of things they would do as part of the purchase agreement... such as provide floormats, a manual, and a CARFAX report. Not one of the promises on the signed document was fulfilled... and as far as the title goes, that took almost two monts to recieve from this place. I called, and the secretary would make up excuses every time about the supplier of the car going through bankruptcy, and getting the title is taking forever. The title fees were rolled into the loan... and they said it would take two weeks to cut the check for the fees back to me and hand it over to me with the title... two months as well. Funny thing is, Suzuki claimed they did not have my money yet, but the bank informed me Suzuki picked it up in person 2 days after the purchase. Chad is a fraud, a jerk, and a shifty businessman. Daddy gonna bail him out... What a joke. The sales staff have the same lack of personality and integrity as Chad. When the State of Nebraska along with the DMV say they will not accept anything but cash from a local business you know there is trouble, too bad I found out too late. The place is pretty, but it's dirty... IT'S D I R T Y!
Happy to see you out of business Chad, hope daddy keeps you out. Maybe you can run your boat shop into the ground too! "

" Well...it's all catching up with Chad Gutschow. From personal experience, the guy has had an issue with paying his bills. To me it's obvious that Chad couldn't pay back the bank(in California)for the car(s) that consumers have purchased--so the bank in CA could NOT release the title--Thus no clear title and the buyers can not license their car. Over spending in other areas of your life Chad? It's too bad other people get hurt so you can lead your BIG life. Very sad. You play hard ball, they play hard ball and you eventually come to an agreement. Everyone is speaking of "bad" experiences...I wouldn't consider not getting "your way" a bad experience. Car dealers need to make money also. "
