Inmate sues over missing porn

Someone’s stealing Nebraska State Penitentiary inmate Raul Calderon’s adult magazines, he claimed this week, and he wants a federal judge to get to the bottom of it all.

Calderon, 31, said in legal papers that, since about October, he did not receive between 10 and 15 issues of three magazines he subscribes to. Two of the magazines have been described as pornographic, and the third as “adult male.”

He laid blame on corrections staff, who have singled him out, Calderon said in a lawsuit Wednesday in U.S. District Court.

“Under information and belief I believe (I’m) singled out for I hear how other inmates receive (their) issues,” he wrote.

Calderon said he made inquiries, through the prison’s grievance process, to the prison mailroom and was told no magazines have been processed for delivery to him.

He accuses staff of tampering with his mail and violating his rights under the First and Eighth Amendments to the U.S. Constitution. He is seeking up to $500 for each issue not received.

Calderon is serving sentences of 10 to 20 years for attempted second-degree murder, and 5 to 10 years for use of a weapon in Lincoln County.

Just becasue a lawsuit is filed does not mean it is going to go anywhere. The reason so many are appalled at this frivilous lawsuit is this: You and I are paying for his legal fees to be frivilous. No one would pay for my fees...and b/c of this prisoners are also encouraged to file such things. I would guess this relieves their frustrations to a degree for being in the positions they are in. Yes, they have more rights. They have their dental, medical, food, lodging, recreation (no matter how slight it may be), cable, electricity, heating, air conditioning, water, laundry, clothing, personal care, college education, internet, and finally (if I didn't leave anything else out).........LEGAL FEES paid for.

Most of us, have to decide which things we can have the luxury of affording. Most of us pay tuition, and all the above mentioned things.

Criminals do have more rights than their victims.........don't fool yourself. No one pays for a victims and their families counseling, medical expenses when applicable or the trauma they live with. While crimes are committed against individuals, the legal system plea bargains away thus minimizing the harm done to another person. "

An inmate does get food and shelter provided for them. So do a lot of people outside of jail. I get angrier at the people selling food stamps for drugs then at someone being upset because they are not receiving items that they or their loved ones paid for it.
Yes they have access to work out equipment but it's not like it's filled with brand new equipment. People on the outs can go to a recreation center and work out for free.
As far as the remark of adult magazines not being allowed to a US solider fighting war I am not sure how true that statement is. I do know that my best friend sent naked pictures of herself to her boyfriend and he is currently in Iraq, it's the same thing, a naked woman.
People like to find things/people to blame any and everything on. That will never change. If you don't like how our prisons are ran become a warden and change it.

" well, at least you learned from your mistakes, hopefully. now here's something for you to think about with your 3.85 a day. for one, most inmates do not solely survive on their 1.21-3.85 a day, they get money sent in from family members and friends. i know plenty of inmates that have more money on the books than i have in my checking account, simply because they don't pay rent, pay for their three free meals a day-which aren't that bad overall-pay for clothing, etc. nobody is saying its a picnic, but its not supposed to be. they have made prison not something to be feared, but basically a cheap hotel with room service that pay's you to be there. and i have seen many inmates who actually get paid more an hour than the security staff assigned to watch them, since for the 2.25 they work approximately ten minutes of the day, get free healthcare, clothing, rent, food, cable, etc. it's not all that bad. "

SOME inmates do get money sent in.alot dont. i didnt. as far as not paying rent goes, by the time you have reached the point where you can get out on work release you ARE paying rent. admittedly not what you pay on the streets but the bill is still there.is that a bad thing? no. but do you really want to put an inmate with no skills and no real prospects out on the streets without anything? because guess what, that is what contributes to them reoffending. im not defending anyone. i was fortunate enough to have some people help me when i got out but alot of inmates dont. all im saying is that prison is not the country club some people seem to think it is.if you do think its not that bad.go sell a bag of weed to a cop and find out for yourself.personally ill take all the headaches and stress of life out here over prison any day. by the way- you know plenty of inmates? me too. and i havent met one who feels prison is a good deal "
