Regents settle with Hergert over chicory lawsuit

An attorney for the University of Nebraska Regents said the university has settled the remainder of its legal fight against David Hergert over a chicory crop.
Attorney John Horan said Friday the case had been resolved and that he expected a dismissal request would be filed next week in Scotts Bluff County District Court.
He would not disclose the settlement terms.
Hergert’s company U.S. Chicory had already been ordered to pay more than $170,000 to the university’s Panhandle Research and Extension Center and another chicory farmer. Hergert’s company had failed to pay them for chicory delivered in 2006.
That judgment left the decision of Hergert’s personal liability for trial.
Meanwhile, U.S. Chicory faces another lawsuit. Source Gas said in a court filing that the company failed to pay $74,000 for gas.
Hergert, a former Nebraska regent, was ousted for violating campaign finance laws.
