OMAHA — A Douglas County jury deadlocked on an assault charge against a man accused of trying to run down an off-duty police officer, prompting a mistrial.

Judge Thomas Otepka said Wednesday the jury couldn’t reach a decision on the charge of felony assault of an officer, but found Koko Sessou not guilty of assaulting a DJ at a west Omaha bar.

The jurors deliberated three days before Otepka called the mistrial.

Sessou was shot during the April 22 incident in front of the bar.

Officer David Brumagen has said he fired at Sessou’s car because he thought Sessou was driving at him. Brumagen was working as a security guard at the bar.

Sessou’s attorney, James Martin Davis, said his client wasn’t trying to hit Brumagen and that his injuries back that up; Sessou was shot in the back.

" How do you get charged for assaulting an officer, when you didn't know it was an officer, can't that just be assault? And if the suspect wasn't trying to run down the security guard, but the security guard shot him in the back anyway, isn't that a little bit scary? I mean this guy patrols the city with a gun as part of his job. Not everyone is meant to be a cop, or carry a gun. "

" The off-duty officer WAS the security guard. He was in uniform. Officer's, both in Omaha and in Lincoln, frequently provide security for private entities as a form of outside employment (at no cost to the city, I might add). Now, how the suspect was shot in the back, I don't know. I don't have all the facts and, therefore, should not be making comments about the situation. "

" Bad headlines strike again! Headline implies the off-duty officer was shot.
Read the article, and its the off-duty officer who shot the guy. "
