Inmate dies after incident at prison

Jasper Falkner ran a left hand over his nephew’s unresponsive right eye and contemplated a life or death decision.

Would he take his nephew, an inmate at the prison in Tecumseh, off life support?

“Pull the plug, probably,” Falkner answered. “I want him to be where he wants. He turned his life over. He believed in God. He made his peace.”

Reko Mitchell, 38, died hours later, Wednesday night at BryanLGH Medical Center West, according to his family’s attorney, James Martin Davis. He died as a result of an incident in the prison’s gymnasium bathroom that left him with two broken bones in his neck.

The Nebraska State Patrol is investigating. And Johnson County Attorney Julie Smith-Hogancamp said earlier this week she is looking into the matter, though no charges have been filed.

Prison officials would not release the name of the other prisoner believed to be involved, though a spokeswoman has said officials took steps to prevent him from causing further incidents.

Mitchell was 15 years into a 37-year sentence on multiple felony counts out of Douglas and Lancaster counties, including one count of sexual assault, two counts of using a firearm to commit a robbery and four counts of robbery.

Fred Britten, warden at the Tecumseh State Correctional Institution, said a security staff member typically watches the gym, and the incident isn’t going to change how the gym is guarded.

“This was just an isolated incident that occurred,” he said.

He said he believes Mitchell and another inmate were fighting in the gym bathroom at about 1:30 p.m. Sept. 17.

Other inmates were in the gym, but Britten didn’t think there were any witnesses. Mitchell was found on the floor.

The family bristled at the suggestion Mitchell was involved in a fight.

Falkner said his nephew’s face showed no bruises or scratches that would suggest a fight.

“It was a one-sided altercation,” said Davis. “I think the guy grabbed him and snapped his neck in two places.

“They have no evidence whatsoever that it was a fight.”

Family members from Lincoln and Omaha on Wednesday questioned why it took two days to learn Mitchell was hospitalized.

Britten said the person Mitchell listed as his next of kin was dead. Prison staff could only make contact with one family member, who lived out of state. Prison spokeswoman Dawn-Renee Smith said there weren’t any local contacts on Mitchell’s phone list.

Mitchell’s prison chaplain contacted local relatives, said Frances Erwin, Mitchell’s aunt. They’ve been visiting the hospital every day since, she said.

At 3:45 p.m. Wednesday, she and other family members gathered in a conference room with Mitchell’s doctor, where he laid out the patient’s options.

Before that meeting, Falkner said he looked forward to retrieving Mitchell’s writings from prison. Mitchell spent a lot of time writing poetry and letters to his family.

The last one he sent to Helen Martin, an aunt, described how he had been saved and turned his life over to God. Martin said he took a greater interest in finding religion a little more than a year ago, when he had to make the decision to take his mother off life support.

“He seemed like he really changed.”

" It is always sad when we loose someone no matter what path in life they might have taken, this man is worth no more or no less then anyone else. I have worked for the Department of Correctional Services here in Nebraska and have not read anything that would indicate that Tecumseh correctional staff did anything to contribute to the death of Mr. Mitchell, things happen in this world that can't be explained by rational human beings; they happen more so in prison where the entire population is comprised of those individuals that couldn't follow societal rules and have little if any regard for anyone else. My thoughts and prayers go out to Mr. Mitchell and his family and I hope they focus on the recovery process and not on finding blame. "

" that this family is going through all of this and no charges have been filed. Hopefully enough evidence can be gathered and they can find the person who did this guilty in a court of law. I'm curious to know how long the person who did this has to serve and what for. If there truly was no brusing or scratches or anything I would believe that someone came up and snapped his neck if presented the proper evidence and motive. " I knew Rico pretty well, he had his issues as anyone else. He always treated me with respect and kindness. I know he made some wrong and terrible choices, however, he never deserved this. As a family, we will recover because we all believe in God however, you dont just lose a life and call it a day. We want answers. Not that we are looking for someone to blame in a sense, we want accountability. Could you imagine having a loved one in a hospital on life support, basically gone already and not finding out for two days the seriousness of the incident. Not only that, how callous is it to say that the incident happened in the gymnasium and its not going to change the way the gym is secured. What the world is that? Obviously, SOMETHING needs to be changed...a man was murdered! That only seems like common sense to me. The man that did this to my cousin as well as the prison staff need to take accountability for what happened...bottom line. "

" I send out my deapest sympathies to the Family of Reko. I want them to know that I spent a lot of time talking to Reko about his life as well as mine. I worked with him through struggles with family, friends, and hardships. Reko did the same for me. While working at Tecumseh State Correctional Institution I thought of Reko as a very good inmate, he had a few issues, but loved to spend his time with religon and writing poetry (I really hope the family publishes some). It's a terible thing that happened to Reko, and I hope --------- is glad that on the 16th he had 11 months to get out, now it'll be LIFE. "
